Can your drone fly over people?

Answer four questions about your drone to see which operations-over-people categories it qualifies for, and where it may fly. Built on 14 CFR Part 107, Subpart D, the most-missed topic on the remote pilot test.

Operations Over People

Can your drone fly over people?

Four questions about your drone, and a clear answer with the rule behind it.

1. What does the drone weigh on takeoff, with everything attached?

Include the battery, payload and any accessories.

2. Does it have exposed rotating parts that could cut skin?
3. Is it listed on an FAA-accepted Declaration of Compliance, with a Category label?

The manufacturer declares this, not the pilot. Look for the Category label on the aircraft.

4. Does it have an FAA airworthiness certificate (Part 21)?

Rare for small drones today.

What is a Declaration of Compliance?

78.58%how often knowledge code UA.I.E.K13 is missed, July 2024 to June 2025. The most-missed code on the remote pilot test.

UA.I.E.K13 is the Declaration of Compliance. Here is what it actually is.

  • An applicant, usually the manufacturer, declares to the FAA that a drone meets the Category 2 or 3 requirements (§107.160 (opens in a new tab)).
  • Compliance is shown through an FAA-accepted Means of Compliance: the test, analysis or inspection method (§107.155 (opens in a new tab)).
  • The drone must carry a permanent English label showing its category (§107.120 (opens in a new tab) for Category 2, §107.130 (opens in a new tab) for Category 3).
  • The FAA can rescind a declaration if the drone no longer complies or the declaration is false, after notice and 30 days to respond. In a safety emergency it can act immediately.
